Much is often made of solutions for gun deaths which never would have resolved the situation that spawned the suggestions and are ultimately more of a political power grab by forces who seek to punish law-abiding citizens from exercising their Constitutional right to keep and to bear arms. Being a Libertarian which views the Constitution on a level of what it says is what it means, I offer the following solution to resolve the rising crime rate across the nation and seek to normalize weapon related penalties. PLANK ONE;   No one may be "gifted" a firearm without having reached the age of majority AND without passing a universal weapons check to verify that you are able to possess a firearm.    All records, both juvenile and adult criminals ones, must be searched and any conviction of a violent crime shall be subject to banning from owning any firearm.   Violators of this proposal shall be subject to both banning of possession of firearm - an unlawful gifting of a firearm to a person who has not obtained clearance to own the firearm shall have their ability to possess any firearm permanently banned; there can be no "surprise" gift recipient of said firearm.    It is required that anyone who is going to be a recipient of intent to gift be notified of such intent and be required to act to get clearance to own the firearm.    Failure to get prior clearance shall mean said "gift recipient" as banned from ever possessing a firearm.   Any person who is subjected to "a surprise gift" shall be required to decline the gift and to notify authorities of the person who is surprising them with said gift; all procedures shall assume failure to notify authorities is intent to violate the provisions of the law and will render gifter and giftee as permanently banned from possessing a firearm of any kind for life. PLANK TWO:   Adoption of a universal standard that shifts the current purging of juvenile records when the juvenile becomes an adult to a permanent requirement that juvenile criminal records become an establishment of a history or pattern of conduct that must be used to consider ability to possess and to purchase a firearm (or to have one given to them);    A person's "life history" of criminal, violent conduct is integral to building a character assessment of future law abiding standard.    A history of violent crime shall be presumptive of a continuation of such a life and render that person incapable of owning a firearm.   The Constitutional right to keep and to bear arms requires the obligation of the citizen to not to infringe on the expressed rights of others and when that person is in violation of the Constitutional rights of others, that person forfeits any ability to possess a firearm of any kind for life. PLANK THREE:   There shall be no tax or impedance by the Government to possession of any amount of ammunition or to restrict the amount of ammunition held by device or its inserted magazines provided the owner of the firearm is of legal possession standard compliance. PLANK FOUR:   All firearm verifications must be updated and a national database of those who are legally approved shall be maintained and searched during the commission of any violent act; those who are otherwise legally able to own a firearm but who are convicted of a violent offense of any kind shall be immediately banned from future ownership and their approved status will be revoked in the database. PLANK FIVE:   All sales of firearms of any kind regardless of the venue with which the firearm is to be sold shall be subject to seller legal verification of ownership as well as potential buyer of the weapon; should either party be determined to be in non-compliance with ability to own or to posses the weapon, imprisonment shall be mandatory and permanent ban of ownership and possession shall be noted with all provisions above grading the violator at serial non-compliance which will be used for escalating imprisonment penalties. PLANK SIX:   All firearm owners shall be required to take gun safety classes for each weapon owned and shall have those completion verifications logged in the national database; any such person who cannot verify that they have completed a gun safety course for a particular weapon shall have that weapon confiscated and a history noted in the database that would ban them from acquiring any future firearms.    Serial violations of compliance with safety class for each firearm will result in potential of all weapons being seized and permanent ban of owning firearms in the future. PLANK SEVEN:    All firearms shall be required to be stored in safety locations within the domicile or other visited areas that require two locks - an external lock that is opened to expose a secondary locked area that is either keyed or coded with different access abilities - no two of the same lock - no two of the same combination or key.   All firearms shall be required to be stored without ammunition within the firearm or within the same firearm safety device.   Ammunition is not required to be locked up or secured. PLANK EIGHT:   Any person who is arrested in the commission of any crime who possesses a firearm that is not of their legal right so to own shall be subject to a mandatory term of imprisonment for no less than 20 years with escalators for serial violations up to a life sentence. PLANK NINE:   There shall be no restriction on the type of firearm a citizen my own provided all requirements above are followed and with owner being in compliance for EACH device.   It is the intention of all provisions above to make it harder to own a collection of firearms and seeks to ensure responsible conduct for those who seek so to do.    It should be noted that each owner should also retain records of their compliance with gun safety and ownership transfers; failure of proper record keeping shall place the one in possession of said firearm at the mercy of government records - failure to refute errors with proper document shall result in confiscation of the entire collection and permanent banning of the weapons. PLANK TEN:   Every citizen shall be afforded their Constitutional right to keep and to bear arms, but the actions of the citizen which run contrary to responsible conduct of that right shall be grounds for an implied declaration that the citizen waives the right to keep and to bear arms.    All violations of these standards above shall be prima facie standards of abdication of said Constitutional right and a prima facie violation of responsible conduct by the citizen.    Any non-citizen has no right to possession of a firearm and any such possession shall result in immediate removal from the country and grounds to return the non-citizen to his country of origin.
